Member Roundtable on Andary Lawsuit

The Michigan Supreme Court will hear oral arguments in the Andary Lawsuit on March 2, 2023.  Attendees of this Member Round Table will hear attorneys Steve Sinas and Lauren Kissel discuss the hearing and timeframe for the Supreme Court to render an opinion.  

The Court of Appeals ruling in the Andary Case required that insurance companies are legally obligated to pay the benefit claims of persons injured prior to the effective date of the new law, based upon the benefits that were available to such persons prior to those law changes. Therefore, such patients cannot have their medical expense benefits reduced by fee schedules, nor can an insurer limit reimbursable expenses for family provided attendant care to the hourly limitations set forth in the law. The case has binding precedential effect unless it is overturned by the Supreme Court.

Payments from some insurers to providers and caregivers are including clawback clauses. A clawback is a contractual provision whereby money already paid to a party must be returned. Insurers are including these clauses that state payments made must be returned if the Supreme Court overturns the Andary case.  A portion of the round table will include a discussion about how to recognize these clauses.
