In the face of challenges resulting from the 2019 changes to the Michigan Auto No-fault Law, our resilience has been tested, and political leaders seem to continue to overlook our struggles. We've mourned the loss of dedicated advocates, and the exhaustion is palpable.

However, amidst these trials, we must not lose hope. Working hand in hand with lawmakers, CPAN is actively addressing the shortcomings of the fee schedule, the limitations on family-provided attendant care, and other detrimental aspects of the law. Additionally, the law also faces challenges in the courts and CPAN is actively engaged in these challenges as well. 

The credibility and reliability of CPAN’s voice was recently recognized by the Michigan Supreme Court who has invited CPAN to submit Amicus Curiae briefs in auto no-fault cases pending before that Court. These cases could impact the rights of patients to access high quality medical care and the rights of providers to be adequately reimbursed for providing that care. The Amicus invitations by the Michigan Supreme Court clearly confirm that, in matters dealing with the Michigan Auto No-Fault Law, CPAN has indeed become an important voice that should be heard and carefully considered.

RALLY at the Capitol: END THE AUTO NO-FAULT CARE CRISIS NOW!

There is no denying the carnage the fee schedule and limits on family provided attendant care have had on people with catastrophic injuries, their families and the professionals who dedicated their lives to providing high-quality services. While the people that were able to survive the tumultuous past two years obtained relief provided by the Supreme Court’s ruling in Andary that reverts the pay system back to “reasonable charges” for those injured prior to June 2019, people injured since will experience the same level of difficulty in finding access to care.
 
This is precisely why we need a legislative solution, or the Crisis in Care will continue. Stakeholders have been working diligently to put forth a legislative fix.  It is up to our Legislators now to ACT NOW! and END the Care Crisis. 
 
We need to harness the enthusiasm, tenacity, and commitment of our no-fault community.  The purpose of the rally is to show lawmakers and the administration that action is needed now and that our voices need to be heard – let’s work together to mitigate the damages.
 
Join Michigan Brain Injury Providers Council (MBIPC), We Can't Wait, the Brain Injury Association of MI (BIAMI), the Coalition Protecting Auto No-Fault (CPAN), the Interfaith Coalition and thousands of members, organizations, and survivors on October 3, 2023, as we rally in front of Michigan's State Capitol from 11:30 AM - 1:30 PM.   The rally will include speakers from the survivor and provider communities, lawmakers, and other stakeholders along with a memorial for those that have passed since the 2019 changes in the law.

Member Roundtable on Andary Lawsuit

The Michigan Supreme Court will hear oral arguments in the Andary Lawsuit on March 2, 2023.  Attendees of this Member Round Table will hear attorneys Steve Sinas and Lauren Kissel discuss the hearing and timeframe for the Supreme Court to render an opinion.  

The Court of Appeals ruling in the Andary Case required that insurance companies are legally obligated to pay the benefit claims of persons injured prior to the effective date of the new law, based upon the benefits that were available to such persons prior to those law changes. Therefore, such patients cannot have their medical expense benefits reduced by fee schedules, nor can an insurer limit reimbursable expenses for family provided attendant care to the hourly limitations set forth in the law. The case has binding precedential effect unless it is overturned by the Supreme Court.

Payments from some insurers to providers and caregivers are including clawback clauses. A clawback is a contractual provision whereby money already paid to a party must be returned. Insurers are including these clauses that state payments made must be returned if the Supreme Court overturns the Andary case.  A portion of the round table will include a discussion about how to recognize these clauses.

This town hall will address a wide variety of topics and concerns important to those who have been injured and their families, including:

  • The rights of no-fault insurers to limit payment to injured people’s medical providers

  • The rights of insurance companies to limit payment of attendant care provided by family or friends

  • The legal challenges to the new no-fault reform rules

  • The new power of government to regulate and limit the care of auto accident survivors

  • The new rules regarding when injured people must go undergo medical evaluations at the request of their insurance company

Additionally, the new law made significant changes regarding tort liability claims. These 2019 changes in the law made filing claims overly complicated, with several important rules and requirements that must be followed in order to protect the legal rights of crash victims. It is imperative that providers rendering care to these patients covered by no-fault insurance thoroughly understand these differences. Medical providers are subject to “fee schedules," accreditation requirements, utilization review rules, and other oversights previously not required before the 2019 changes limiting covered services for patients.

Survive & Thrive goes virtual for 2020!

This year would have been the 9th anniversary of Survive & Thrive, CPAN’s annual art sale and reception hosted by WorkSkills and Studio West Gallery. But social distancing and limitations on gatherings have forced this year’s event to take a different twist. We didn’t want to forsake this opportunity to showcase and sell art while raising much-needed funds for CPAN, so we are going to host a virtual event. This year’s Survive & Thrive event will take place on Sept. 10 from 4:30 p.m. until 6 p.m. via Zoom.

There are lots of fun elements planned for this virtual event. Zoom in and share a special signature beverage and appetizer together. There will be raffle drawings throughout the event, a special musical guest performance, and of course the chance to bid on some beautiful art. Chat with the friends you have been missing these past few months while working remotely. And, you don’t have to wear a mask to participate!

Your support is critically needed. Please register as a Blooming sponsor for $350.00, which includes: the opportunity to air a 30 – 90-second video about your organization (you provide) during the event, your logo on two Facebook posts leading up to and after the event, and recognition in the CPAN newsletter along with a 2020 commemorative art piece.
